MBABANE – Bring back our money now! This is the demand by Haja Investments (Pty) Ltd (plaintiff) which has taken the Principal Secretary in the Ministry of Economic Planning and Development, Microprojects and the Attorney General (all defendants) to court over due retention fees worth E507 246, which had been withheld as a security for professional errors in construction of a skills centre at Emvembili in the Hhohho region, valued at E6.7 million.

Principal Secretary at the Ministry of Economic Planning and Development is Bertram Stewart, the Director at Microprojects is Sibusiso Mbingo and the Attorney General is Sifiso Khumalo.

Explaining the background to which ultimately culminated to the demanded half a million, whose payment is being demanded forthwith, Haja Investments, whose offices are located at the Matsapha Industrial Sites, submitted that Kapson Investment was awarded a tender for construction of the skills centre in February 3, 2016.

Haja was then engaged by Kapson as a sub-contractor.
It was stated that as time went by and as financial constraints intensified, the directors of Kapson opted to withdraw from the agreement and ceded their right and obligations thereunder, wholly to Haja Investments.

It was mentioned that an agreement of cession was made by Haja and Kapson verbally.  Microprojects were also verbally informed of the new arrangement between the two companies.

“Haja Investments took over the construction exercise of the skill centre as per the deed of cession,” reads the particulars with allegations whose veracity is yet to be tested in court.
