TECHNOSOL SOLD US SECONDARY GOODS - EASY BUY SUPERMARKET

MBABANE – “Technosol Technology Solutions (Pty)Ltd supplied secondary machinery and equipment contrary to what was agreed”


These were allegations made by Easy Buy Supermarket in a matter where Technosol has taken them to court for alleged failure to pay in full for office machinery supplied to its newly-opened store.
Easy Buy Supermarket allegedly received office machinery worth E80 142 from Technosol after the parties concluded an agreement of sale.
However, the supermarket allegedly paid only half of the amount and Technosol is now demanding that the former settles the balance.


Technosol Technology Solutions (Pty)Ltd is seeking an order compelling Easy Buy Supermarket to pay a sum of E40 142, which is the outstanding balance.
Technosol Technology Solutions (Pty)Ltd’s principal place of business is at the Development House, Swazi Plaza.


In their responding papers, Easy Buy Supermarket alleged that the second hand machinery caused their point of sale system to breakdown rendering it unworkable.
They alleged that Technosol Technology Solutions (Pty) Ltd supplied the wrong make and inferior machinery, as they delivered a Proline Printer instead of a Epson Printer.


They alleged that the company also delivered an LG Touch Screen instead of a Samsung Touch Screen and an ordinary generic scanner, instead of a switchbox scanner.
The supermarket further alleged that Technosol Technology Solutions (Pty)Ltd failed and or neglected to commission the machinery and equipment sold on site as per the parties agreement, resulting in system failures and errors, as a consequence thereof the said goods did not carry out their expected function.


Possession


“In addition, thereto, Technosol Technology Solutions (Pty)Ltd removed from Easy Buy supermarket’s possession at the premises sales screens valued at E1 200 each, for which amount the plaintiff are liable to first defendant which constituted part of the aforesaid sale,” the supermarket alleged.


The supermarket contended that they were not indebted to Technosol Technology Solutions (Pty)Ltd for the balance of the purchase price or any amount at all as the plaintiff allegedly failed and neglected to supply the equipment ordered.
The supermarket further disputed that they were in breach of the sales agreement


They alleged that it was Technosol Technology Solutions (Pty)Ltd that was in breach of the sales agreement, in that they failed and neglected to supply new equipment and machinery of specific make and quality as envisaged by the parties.


Easy Buy Supermarket and Mohammed A. Chowdury, the first and second defendants respectively, prayed that the claim be dismissed against either of them in the amount claimed with costs at attorney and own client scale.
