MBHILIBHI DEMANDS E232 081 FROM SWAZI DREDGING

MBABANE – Mbhilibhi (Pty) Ltd wants the directors of Swazi Dredging (Pty) Ltd to pay them E232 081.50 in respect of services rendered.

Mbhilibhi (Pty) Ltd and Swazi Dredging (Pty) Ltd are private limited liability companies carrying their respective businesses at Ezulwini, Hhohho Region. The plaintiff (Mbhilibhi (Pty) Ltd) instituted a claim against the defendant (Swazi Dredging (Pty) Ltd) in which they alleged a sum of the aforesaid amount purportedly being in respect of services rendered by the former to the latter at the specific instance and request of the latter. Directors of Mbhilibhi (Pty) Ltd claimed that the E232 081.50 had now become due, owing and payable. The plaintiff alleged that despite demand, the defendant had failed and or refused and or neglected to make payment. These are allegations contained in the plaintiff’s particulars of claim whose veracity is still to be tested in court and the respondent is yet to file its detailed papers in the event it is disputing the claim against it.

The plaintiff is demanding the payment of the aforementioned amount and that its compensation should incur an interest of 9 per cent per annum. Mbhilibhi (Pty) Ltd further sought that the costs of suit be incurred by the defendant. In the event the defendant was disputing the claim, Mhlanga was advised to within 10 days of receiving the summons to file their notice of intention to oppose and serve a copy thereof to the plaintiff. Thereafter, the defendant was further advised that they should within 21 days after serving notice of intention to defend, file with the registrar of the High Court and serve upon the plaintiffs’ attorneys, a plea, and exception, notice to strike out with or without a counter-claim.
