FSRA’S MAJOR OPPORTUNITY FOR LAW FIRMS
MBABANE – FSRA is embarking on a process to identify a limited number of external firms of attorneys to appoint to its panel.
The Financial Services Regulatory Authority (FSRA) is a category ‘A’ Public Enterprise established in terms of Section 7 of the Financial Services Regulatory Authority Act No: 2/2010. The Authority has since issued a request for proposals (RFP) which has been posted on the Eswatini Public Procurement Regulatory Agency (ESPPRA) website. The firms are needed to provide ad hoc specialised services for a period of four years, as and when the need arises.
Proposals
Law firms have been invited to send their proposals for consideration. It is expected that the prospective bidders should have thorough working understanding of the Public Procurement Act 2011and subsidiary legislation or circulars applicable to public enterprises. Interested firms of attorneys should select not more than four areas of specialisation for consideration by the panel, clearly indicating, by means of a cover letter or otherwise, the area(s) of specialisation in respect of which their specific RFP applies. “FSRA will appoint not more than five law firms per area of specialisation.
Invitation
“All firms are to ensure that all Attorneys have a minimum recognised Bachelor of Laws (LLB) degree or equivalent and must be admitted as attorneys and have a right of audience before the courts in Eswatini,” reads the invitation in part. The successful bidder will provide legal opinions on a broad range of issues. These include guidance and representation on civil proceedings; assist in drafting of international agreements to be entered into by the FSRA; ensure technical quality, adherence to best practice and consistency with the Constitution; conduct litigation on behalf of the FSRA; and ensure effective and efficient litigation process is followed, among others.

Prospective bidders must submit detailed curriculum vitae and/ or resume of attorneys and/ or directors and junior attorneys to be utilised for FSRA related instructions, for the area(s) that the bidder is tendering for, (in case the firm is appointed into the panel) with certified copies of their respective qualifications.
