ERS DEMANDS OVER E45 MILLION VAT

MBABANE – Eswatini Revenue Service (ERS) is demanding over E4.5 million from three companies in respect of Value Added Tax.

VAT is an indirect tax that is levied on the consumption of goods and services in the country. It is also levied on the importation of goods and services into Eswatini. VAT is to be paid by a person who brings taxable goods or services into Eswatini (usually the importer). A person who receives supplies of taxable goods or services in the country also pays VAT. A person in this case includes any individual, partnership, company, trust, government and any public or local authority.

The defendants in the matter have been identified as Pub and Grill (Pty) Limited, MS Civils (Pty) Limited, and Rehoboth (Pty) Ltd trading as La Casserole. The latter is said to be a company duly registered and incorporated in terms of the company laws of the country and has its principal place of business at Omnicentre, Gwamile Street, Mbabane. ERS wants over E1.159 million from the business which is said to be outstanding VAT as at September 7 this year.

From Pub and Grill, ERS wants over E2.14 million, which is said to be outstanding VAT as at September 1 this year.  Pub and Grill has been identified as a company that has its principal place of business in Ezulwini. MS Civils is said to be located in Manzini and ERS wants at least over E1.22 million for the same tax. This amount has been reportedly due as at September 7 this year.

In essence, the total claim by ERS is about E4.5 million. “Monies are now due, owing and payable and despite lawful demand having been duly made, the defendant persistently refuses, fails and/or neglects to pay same to plaintiff,” alleged ERS. These are allegations contained in summons whose veracity will be tested in court. Attorneys from S.V. Mdladla and Associates are representing ERS.
