SWAZI JIVE BOSS TAKEN TO COURT
MBABANE – The Director of Swazi Jive Entertainment, Sakhile Nkambule has been called upon to appear at the High Court for the investigations of his financial standing.
Nkambule has been ordered to be present at the High Court on Friday at 9:30 am. The order by the High Court comes after his former business partner, Kyle Matsimbe, who is demanding E110 000 from Nkambule and his company, moved an application in terms of Rule 45 (13) (i). The application by Matsimbe follows Nkambule’s alleged failure to pay the aforementioned amount despite the parties having signed an agreement for an out of court settlement.
Agreement
In the agreement which has since been forwarded to the court, the defendant (Nkambule) had agreed that he would make a down payment of E30 000 and pay the balance of E80 000 in two instalments. According to Matsimbe, the defendant, however, allegedly failed to pay him in terms of the agreement. These allegations are yet to be tested in court. Giving a background of the matter, Matsimbe narrated that on August 24, 2016, he entered into a written agreement with Dlamini. He averred that in terms of the agreement he (Matsimbe) was to inject a sum of E260 000 into Swazi Jive Entertainment’s musical festival,commonly known at Hipnotik Festival. According to Matsimbe, the material terms of the agreement were inter alia that; the investment of E260 000 would be returned with a profit of 20 per cent and further that in the event the festival suffered a loss; the then plaintiff (Matsimbe) would get back the sum of E260 000. The plaintiff informed the court that at all material times, he represented himself and Nkambule represented Swazi Jive Entertainment as its Director, he submitted that he duly paid the sum of E260 000 to Swazi Jive Entertainment’s account in fulfillment of the obligation in terms of the agreement.
Agreement
“In breach of the agreement between the parties, the defendants (Nkambule and Swazi Jive Entertainment) has to date paid the sum of E150 000 on different dates between June 22, 2016 to June 27, 2017,” contended Matsimbe. He argued that consequently the defendants were indebted to him in the sum of E110 000 which amount was now due owing and payable. Matsimbe alleged that despite demand, the defendants had failed, refused and/or neglected to pay him the aforementioned amount. The matter is pending before court and appearing for Matsimbe is Noncedo Ndlangamandla. Nkambule was previously represented by lawyers from Sukati- Msibi Attorneys who, however, withdrew from representing him and his company.
