Who has Marwick killed?
In siSwati when things just don’t go right, it is often asked ‘kutsi kantsi wena ubulele bani’?
This when translated to English Language for those of you who may not be able to understand means ‘who did you kill to deserve such treatment’? And this is the question we are asking of the former Lobamba Lomdzala Member of Parliament Marwick Khumalo.
Ubulele bani lomtfwana Khumalo bo? Yes we understood when he was first arrested that it was related to the Commonwealth Parliamentary Association (CPA) and if there is something amiss then he should be held accountable. Now I should explicitly state that I am not a person of the law nor do I have any legal background whatsoever but that does not mean I’m unable to question reasoning behind certain matters.
Now if I understand the law or rather how it should operate, is that if you are arrested and charged while the investigation is continuing then whatever is later discovered shall be added to the already existing charge.
Connection
In Marwick’s case, he was first arrested in connection to the CPA and he was arrested again after more evidence was discovered relating to the case he was initially charged for.
Now what I fail to understand is why then doesn’t the prosecution simply add these charges to the already existing charge sheet instead of parading him as if Marwick was an armed and dangerous criminal.
The way this is being handled leads one to conclude that this is now political and that there is certainly a score to settle with Marwick.
The problem is that it is not clear who the person or people who are out to get to get him but he certainly believes it is the Prime Minister Sibusiso Dlamini. Why, we all wish to know?
Marwick should actually tell us what it is he did that would warrant the Prime Minister to react in such a manner. That is if indeed it is the Prime Minister as he so believes. Nevertheless it is the abuse of the law and shaming of Marwick that I am worried.
As I said I am not a legal person and as such I don’t have any records or cases I can cite where more charges were added without them being re-arrested and paraded.
What makes Marwick’s case different? Phela we can’t forget that he was removed from being Speaker at some point and now this.
The way he is being treated makes him a martyr and that’s why people are being sympathetic towards him. It is now becoming obvious that he is not wanted and his chances, which are very high it would seem, of returning to Parliament are now slim if still existing at all. This basically means the people from Lobamba Lomdzala constituency should start means to identify another candidate because lowa Khumalo umtfwana ngatsi selimshonele.
Everything is being thrown at him and it is obvious that he is not coming out anytime soon. In fact I have every reason to believe that come the secondary elections he will still be behind bars.
Even if he were to apologise right now, it would make little difference as the decision has already been taken to have him out of the picture. Sad to say but such things do not augur well for the country’s image.
It is because of such things that people lose confidence in the law and justice system.
If Marwick has committed a crime then he should be brought to book and should not be paraded in the manner he has been. This is personal and political; it no longer has anything to with justice being served. Instead the law is being abused to serve interests of certain individuals.
I long for the day where Swaziland will have a Judiciary that will be independent from the Executive.
I long for the day where judges will take decisions based on the evidence before and not because someone has interest in whatever case.
