MANZINI – Arrested President of the Swaziland Principals Association (SWAPA) Mduduzi Bhembe is alleged to have arranged for the unlawful release on bail of the former security guard who was sentenced to life imprisonment in South Africa.

Bhembe is further alleged to have convinced the security guard to take the blame for assisting Nontsikelelo Portia Dlamini to copy.
Bhembe and his co-accused, lawyer Sanele Mabila, appeared at the Matsapha Circuit court yesterday on charges of contravening the people trafficking and Smuggling Act and defeating or attempting to defeat or obstruct the course of justice. They made a brief appearance before Magistrate Mthokozisi Dlamini in the packed court house.
The duo was represented by Ben J Simelane law Firm.

Information gathered is that the immediate family members of the pair had arrived early in the morning to see the duo before their appearance.
However, they were not spotted when they (Bhembe and Mabila) made their way into court. The two arrived escorted by police officers just after 10am after Magistrate Dlamini had already arrived.

Dressed casually in an orange  golf shirt, jeans and sneakers, Bhembe quietly made his way through the courtroom and sat at the far end of the bench followed by Mabila, who was dressed in a formal shirt and pair of trousers.
Just minutes after they walked in, their names were called and in less than five minutes, they were remanded in custody until April 6 and escorted back to their cells.

The Serious Crimes Unit, which had been working hand in hand with the Hawks in South Africa, apprehended Bhembe at his home in Siphofaneni, while his attorney was reportedly rounded up in his offices.
According to the charge sheet, Bhembe and Mabila allegedly contravened Section 19 of the People Trafficking and Smuggling (Prohibition) Act Number 7 of 2009, in that on or upon the year 2013, the exact date unknown to the public prosecutor and at or near Luyengo, in the Manzini region, the said accused, each or both acting jointly and in furtherance of a common purpose, did unlawfully arrange or assist Makhosini Matthews Fakudze’s illegal entry into the Republic of South Africa in which the said Makhosini is not a citizen or permanent resident.

“Knowing the fact that Makhosini Matthews Fakudze’s entry to the Republic of South Africa is illegal, in order to ensure that the police investigation on accused number one (Bhembe) for having assisted one Nonstikeleo Portia Dlamini copy the 2012 physical Science paper III were halted, and thus did thereby contravene the said Act,” reads the charge sheet.
