OVER TO YOU JUDGE QINISILE MABUZA

MBABANE – Will a lady judge hold the same view as Judge Titus Mlangeni in the makhwapheni issue?

Judge Qinisile Mabuza is expected to decide on a case where a man is suing another for allegedly committing adultery with his wife.
Of note is that in the case that was decided by Judge Mlangeni, it was a woman who was suing another for being in an adulterous relationship with her husband while the current one is between two men.

Judge Mlangeni recently issued a judgment where he found that a claim for damages arising out of an adulterous relationship was no longer available in Swaziland.
The judge further pointed out that marriage was regarded as a voluntary act of consenting adults and if one of them changes his or her mind due to substantial reasons it was no longer regarded as a social tragedy.

In the present case which  is pending before Judge Mabuza, Sonnyboy Mazibuko who is a civil servant is demanding E550 000 from Ronnie Gamedze who is a teacher at Ngomane Primary School in the Lubombo Region.

Mazibuko is employed by the Ministry of Education and Training (REO offices).
In his particulars of claim he alleged that Gamedze committed adultery with his wife Delisile Mazibuko (nee Mdluli) who is a teacher at Lubombo Primary School.
According to Gamedze he got married to Delisile on December 19, 2002 at Siteki by civil rites in community of property and the marriage still subsists.
