FORMER SENATOR STOPPED FROM SELLING E2.5M PROPERTY TWICE

MBABANE – Former Senator Thandi Maziya and her company have been stopped from allegedly selling a E2.5 million property to two different buyers.


The immovable property, Lot No. 684 situated at the Matsapha Industrial Sites, measuring 4 138 square metres, was allegedly initially sold to Van Wyk and Sons (Pty) Ltd.


According to the Director of Van Wyk and Sons, Cindy Ann Wyk, they later leant that the property was allegedly being sold again to another party.


“Moreover, I have been informed and verily believe that the first respondent is now trying to sell the very same immovable property to third parties for a sum of E2 500 000 despite the existence of the agreement and the full payment of the purchase price by the first and second applicant,” said Ann Van Wyk.


In the deed of sale, Swaziland Perishable Foods (Pty) Ltd is the seller and it was allegedly represented by Maziya in her capacity as director when the sale agreement was concluded.


Van Wyk and Sons took the matter to the High Court, citing a breach of the terms of the agreement of sale in that the respondents allegedly failed to sign the documents to effect the transfer and registration of the property into the name of the former.


Pending finalisation of the matter, Van Wyk and Sons were granted an interim order by Judge Mumcy Dlamini, interdicting the sale of the property. Alternatively, Van Wyk and Sons and Mbhilibhi Family Trust  want the court to order Ekwesutseni Investments (Pty) Ltd and Swaziland Development Finance Corporation (FINCORP) to pay back the monies, E750 000, they allegedly received as part of the purchase price.
