COUNCIL WANTS OWNER ARRESTED AS FLATS CONSTRUCTION CONTINUES

MBABANE – Send that man to prison for 30 days. The above is one of the prayers which is being sought by the Municipal Council of Mbabane, through its Chief Executive Officer Gideon Mhlongo against one of the residents of the capital city.


According to an affidavit filed under a certificate of urgency, the municipality wants Bongani Delisa Dlamini arrested for allegedly breaching a court order which had interdicted him from continuing with the construction of a block of flats at Mangwaneni.


In his founding affidavit, Mhlongo alleged that on February 15, 2018, the municipality obtained an interim order which was to operate with immediate effect and served on Dlamini where the latter was interdicted and restrained from continuing with the alleged unlawful construction of the structure.
Mhlongo claimed that on the return date for arguments, which was April 4, 2018, Dlamini was personally before the court when the judge issued an order to the effect that the matter was postponed pending its finalisation at Ludzidzini.


Mhlongo submitted that at all material times, Dlamini was represented by a Mr Simelane of M.E Simelane Attorneys and therefore there was no doubt he may have misunderstood or did not know the contents of the court order.
Mhlongo further claimed that towards the end of July 2018, the municipality and Dlamini were called to Ludzidzini by Indvuna Lusendvo Fakudze to deliberate about the issue.


“However, when we reached there, we were advised the dispute about the  house (flats) shall be postponed because one member of the royal family had passed on, hence they are not commencing any meetings,” reads the affidavit.
