MANZINI – Sipho Shongwe’s extradition case at the magistrates court stalled yesterday.
His two attorneys, Sipho Mnisi and Lucky Howe said they were not prepared for the extradition application, instead they revealed that they had come for the bail application.
The Principal Magistrate, David Khumalo, however, informed the attorneys that he was not ready for the bail application but the extradition case. “Your Worship, I would humbly apply that the extradition application be postponed to a soon available date,”

He also requested the court to hear both matters on the same day, September 7, 2018.
However, the principal magistrate objected and said it was impossible for the court to hear both matters on the same day, as the court could not be clouded with such issues.
Khumalo further asked the attorney which application he would prioritise, and Mnisi said it was the bail application as it was more important to the respondent.
“A lot could be argued or said on the point of law. The court has also dealt with such matters, it is knowledgeable that points of law take long,” the principal magistrate said.
The magistrate further explained that the attorneys and prosecution should be aware that on Mondays, the court dealt with uncontested civil matters and arguments, which would make it impossible for it to also deal with Shongwe’s applications on the same day.
According to the extradition application filed by Advocate Elizabeth Leonard (nee Jordan), who is the Deputy Director of Public Prosecution for Gauteng, Pretoria Division of the High Court of South Africa, City Sipho Shongwe allegedly did not serve his sentences in full in the neighbouring country.
The application states that Sipho City Shongwe was arrested and slapped with 13 counts in South Africa and was found guilty in eight of the charges. He was acquitted and discharged in the other five counts.
