FIGHT OVER KING SOMHLOLO STATUE
MBABANE – Statues are meant to bring good memories but the over E2 million King Somhlolo bronze statue in the heart of Manzini has sparked a legal battle.
Intellipak LM (PTY) Limited (Pakani), which claims to be the rightful owner of the statue, has since taken the Manzini Municipal Council to court over ownership and commercialisation rights of the statue. Other respondents in the matter are; the Ministry of Housing and Urban Development, National Trust Commission and the attorney general. Intellipak LM (PTY) Limited Director Mpilo Nhlebela claimed that the project was wholly financed by his company, save for the contributions made by the Manzini Municipal Council. So serious is the fight over the ownership of the statue between the two that the matter was also reported to the King.
Opening
The project, according to the director, was officially opened by His Majesty King Mswati III in or about October 2016. He highlighted that during the opening of the project, His Majesty changed the name of the park from Jubilee Park to King Somhlolo Park. Nhlebela submitted that the applicant (Intellipak) was surprised to learn from the respondent (Manzini Municipal Council) that it was the owner of the statue on the basis of it being donated and/or promised by applicant (Intellipak) that after the expiry of the street parking contract, the sculpture would be left to the ownership of the council.
Giving a background of the matter, Nhlebela stated that from or about the year 2007, it entered into a contract with the Manzini Municipal Council. According to the applicant, in terms of the contract, it was to provide street parking services within the Manzini town. Nhlebela informed the court that, in or about November 2013, he personally started engaging the Manzini Municipal Council on a business proposal of building a statue for the council. According to the director of the company, at the time he was liaising with City Planner Zweli Maphanga and Ms Khanya.
