TEST NOSIPHO’S DNA AGAINST VICTOR’S T-SHIRT – WIFE

MBABANE – It would seem the t-shirt which the late Victor Gamedze was wearing when he was killed will be the only solution in the paternity battle between his wife and two children.


The prominent businessman died on January 14, 2018 after he was shot at Galp Filling Station at Ezulwini.
Essentially, it is back to square one for Nosipho Gamedze.


Nosipho is the woman whom the court recently found to be the biological daughter of the late businessman, Gamedze.  
Gamedze’s wife, Lungile and her two children, Tiyandza and Temalungelo, are now appealing the judgment where Judge Nkosinathi Maseko dismissed their application to compel Nosipho to undergo a DNA test.


 In the judgment, Judge Maseko further found that there was no evidence that was placed before the court to suggest that Gamedze was not the biological father of Nosipho.


Daughters


Lungile and her daughters have raised 20 grounds of appeal.
In the appeal, Lungile and her daughters asserted that the achievement of the truth and justice could easily be attained by ordering a DNA test.
Lungile and her daughters are of the view that the blood-stained T-shirt could be used to conduct the DNA tests for the two children, whose paternity is being challenged.


Challenged


The two children whose paternity is being challenged by Lungile and her two daughters are Nosipho and Wandile Zayne Littler.
Wandile is the minor who is also reported to be the businessman’s son but recent underwent a paternity test and the result was inconclusive.


Meanwhile, Lungile and her two children, Temalungelo and Tiyandza, in their appeal, stated that in October 2018 their attorney submitted a letter to the Registrar of the High Court for the attention of Judge Maseko.  According to the trio, in the letter, they were notifying the judge that after the hearing of the matter, they discovered a new and crucial piece of evidence.


Police


Lungile and her daughters asserted that it came to their attorney’s attention that the T-shirt that Gamedze was wearing on the day he died was in police custody. 
They claimed that they further stated that the T-shirt could be made available to them upon request.
