DPP DISPUTES UGANDAN MAN’S PILL CLAIMS

MBABANE -The DPP has disputed the claim by the Ugandan man that the large amount of suspected abortion pills and other drugs he was found with had been prescribed for him.

The director of public prosecutions (DPP) has filed an application for the forfeiture of Kalema Aggrey’s Honda Fit and E37 320. The money and the vehicle are subject of a preservation order granted by the High Court on April 18, 2019. The property, according to the Head of the Asset and Forfeiture Unit in the DPP’s office, Principal Crown Counsel Elsie Matsebula, is proceeds of unlawful activity. In terms of Section 44 of the Prevention of Organised Crime Act (POCA) of 2018, a preservation order expires 120 days after a notice of the order is published in the Government Gazette, unless an application for a forfeiture order in respect of the property is pending before the expiry of such a period.

Crime

In the present application, Matsebula stated that both money and the car were alleged to be proceeds of crime in that the police found Aggrey in his Honda Fit registered WSD 715 AL in possession of E37 320 and 93 cytotec and isovent schedule D tablets. At his residence, police found 401 cytotec and isovent schedule D tablets. Matsebula said investigations revealed that the tablets were used for committing abortion. She submitted that Aggrey was not a licensed medical practitioner and had no licence to possess the drugs. The Ugandan claimed that the pills were a combination of a prescription from his doctor for ulcers and stomach cramps.

He made this submission in his application for the release of his confiscated property. Matsebula has told the court that instead of filing a notice of intention to oppose the forfeiture application, he proceeded to seek the release of the preserved property. According to Matsebula, Aggrey allegedly failed to state who made the prescription or where he was being treated.
“Further such medication cannot be purchased over the counter. There must be a prescription. Aggrey failed to mention where he purchases these drugs over the counter.
