MBABANE – Siphiwe ‘Tata’ Ngubane is expected to, among other things, reveal what Mbuso ‘Ncaza’ Nkosi allegedly told him were the real reasons which resulted in the alleged bad blood between Sipho Shongwe and the late Victor Gamedze.

It is alleged ‘Ncaza’ revealed the real reasons to Siphiwe after he persistently asked him why Gamedze was killed. Ngubane, who is an accomplice witness, is expected to give more details on this subject when he continues giving his evidence before Judge Nkosinathi Maseko this week. Although hearsay evidence is usually inadmissible in court, Ngubane reportedly disclosed in his statement what ‘Ncaza’ allegedly told him was the real cause of the bad blood between the two businessmen. The trial resumed last Wednesday and it was allocated six days, March 17-24, 2021.

Accomplice

An accomplice witness means a witness to a crime who, either as principal, accomplice or accessory, was connected with the crime by unlawful or omission of his part. All along, in his evidence on this subject, Ngubane has been telling the court what was discussed in the alleged meeting in Eldorado Park, which he attended together with Shongwe, ‘Dzodzo’ and ‘Ncaza’. During that meeting, according to Ngubane, Shongwe reportedly told them that kunensizwa, (gentleman) - a fellow businessman in Eswatini - who was taking all business opportunities because he had a lot of money and the problem was that they no longer worked together as before. These are allegations whose veracity is still to be tested and the witness (Ngubane) is yet to be cross-examined by Shongwe’s legal team.

Money

He alleged that Shongwe told them that he wished that the money the businessman, whose name he did not mention, carried in his car be taken from him. However, after Gamedze had been killed and ‘Ncaza’ and Ngubane returned to South Africa, the former allegedly told the latter the real reason why the astute businessman (Gamedze) was murdered. When the matter resumed last Wednesday, Advocate Michael Hellens said the defence feared the evidence of Ngubane. Hellens said Ngubane would give evidence on what happened on the day of the shooting (Gamedze’s murder), what happened in prison in Johannesburg where he (Ngubane) was incarcerated with ‘Ncaza’ and also testify on the audio visual link  (AVL) application by the Crown. However, Shongwe’s legal team has set down the AVL applicationfor arguments on Wednesday. In the same application, they are praying for an order that the Crown be ordered to pay costs.

Meanwhile, the Crown is left with six contentious witnesses to parade. These witnesses, among others, are Nkosi and Ngubane, who are both South African nationals, and chief investigator of the case Sikhumbuzo Fakudze. Some of the witnesses the  Crown had paraded are ; Precious Chauya from Eswatini Revenue Authority, Registrar of Companies Msebe Malinga and Nontsikelelo Zwane, who was employed at Young Heroes. Others who testified are Chief Immigration Officer Makhosi Simelane, Xolani Nhleko of Young Heroes and Eswatini Water Services Corporation Director Strategic Services Sikhumbuzo Tsabedze.
