THABANI WAS ASSISTED OUT OF CAR, DRAGGED - MABILA

MATSAPHA - One of the tasks of the ongoing inquest into the death of Thabani Nkomonye is to establish whether he was assisted out of the car and dragged to an unknown destination or not.

This is because Advocate Mduduzi ‘Tsotsi’ Mabila, one of the three lawyers who are representing the Nkomonye family, put it to a police officer that Thabani was assisted out of the car and that he was also dragged.
Advocate Mabila made these claims after cross-examining Constable Detective Sanele Malindzisa, a police officer from the Forensic Department, who took pictures at the car accident scene after Thabani’s body was discovered on Thursday May 13, 2021 at Nhlambeni and during the post-mortem on May 14, 2021 at Raleigh Fitkin Memorial (RFM) Hospital.

During his appearance yesterday, it appeared that Malindzisa, who is based at Manzini Police Station, had already submitted a written report with pictures to the Coroner, Seniour Magistrate Nonhlanhla Dlamini. As a result, the coroner, including the Director of Public Prosecution (DPP), Phila Dlamini and the lawyers representing the Nkomonye family, had to interrogate his submissions. The police officer was asked about pictures labelled 21 and 22 and he alleged that the photos were close range pictures which showed the position of where the deceased was found lying. He said it also showed that the deceased was found under a tree. Thereafter, he claimed that the only thing that could be seen was the boot that he was wearing and it was what he saw when one Inspector Mngomezulu showed him where Thabani’s body was.

However, he alleged that for one to see Thabani’s body clearly, that individual had to come closer as it was covered by thorny tree branches. Thereafter, the Advocate Mabila wanted to know that since the law enforcer submitted that he was allegedly informed by Detective Sergeant Horton, that he should go to the accident scene, how did Horton notify him, and Malindzisa alleged that he did so telephonically. On top of that, Mabila asked the officer if Horton informed him where he was calling from and in response the witness responded to the negative. He claimed that the sergeant only informed him about where he was supposed to go. Again, the advocate said since the officer had made reference that he was allegedly shown where Thabani was at the scene, by one Inspector Mngomezulu, did he find Horton at the accident scene and he responded to the positive.
