WE WERE SUSPENDED OVER PETITION – ETVA 7
MBABANE – Seven employees of Eswatini Television Authority (ETVA) have been suspended from work without pay.
They have since taken legal action against their employer, challenging their suspension, which they want set aside.According to their court application, the employees were suspended for signing a petition sent to the Minister of Information and Communication Technology (ICT). The petition raised concerns over alleged corruption and mismanagement within ETVA.
According to their application, this happened after the employees met and informed their union about their senior management’s alleged corrupt practices, which they believe prevented ETVA from reviewing and raising their salaries for a long time. The union has claimed that the suspensions are irregular, oppressive and unfair in all circumstances, arguing that STVA management violated the principle of the Audi alterum rule, by not hearing the employees before the issuance of suspension letters.
Violate
According to the union, the suspension letters violate the principles and procedures of the Employment Act of 1980, which are the essential terms and conditions of their employment contract, because they exceed the 30-day limit. The union further states that the accusations made against the employees violate the country’s labour law, and are unfounded and irregular, as their members were not provided with a fair trial, prior to their suspension. The employees represented by the Secretary of the Media Workers Union of Eswatini, Basil Thwala seek their reinstatement and payment of their outstanding salaries. The matter is pending in court and the veracity of these allegations is still to be tested. ETVA has yet to respond to the allegations.
