Kombi driver, conductor face 11 attempted murder charges

MBABANE - A kombi driver and his conductor are facing 11 charges of attempted murder.


The driver of a Toyota Quantum allegedly failed to stop at a red traffic light near Nazarene in Manzini causing an accident where 11 people were injured.
The Quantum trades as Ingane Zakithi Transport.
The driver Sandile Delisa Dlamini has been charged jointly with his conductor, Mazwi Vukani Dlamini of Sigombeni.


In the first count they have been charged with attempted murder in that upon July 22, 2013 at or near Nazarene traffic lights, they wrongfully,  unlawfully and intentionally  caused a public motor vehicle XSD 578 AM, a Toyota Quantum (Ingane Zakithi Transport) to move at a very high speed, entered and crossed a red traffic light, ignored two public service motor vehicles; DSD 949 AM, a Toyota Hiace driven by Sibongiseni Dlamini and further went to knock a Toyota Quantum driven by Mbhekeni Shongwe, which overturned and in the process almost killed Hlobisile Mazibuko of Kwaluseni.

The driver has also been charged with contravening Section 89(1) of the Road Traffic Act of 2007 in that near Nazarene traffic lights along MR 3 public road he allegedly recklessly drove the Quantum.
It is alleged that through the alleged reckless driving the Quantum was involved in an accident with another kombi where two passengers were injured.
He is alleged to have been driving at a high speed, disregarded the condition of the road and the volume of traffic, entered and crossed red traffic lights, failed to apply brakes on time and failed to avoid an accident which a reasonable driver could have avoided.

According to the charge sheet the driver is also alleged to have contravened Section 53(1) as read with Section 122(7) of the Road Traffic Act in that near the Manzini Nazarene traffic lights he failed to comply with a road traffic sign which prohibits public service motor vehicles from entering the city through Nazarene traffic lights after 6am.
The driver alone is facing 12 counts and through his attorney Noncedo Ndlangamandla from Mabila Attorneys he had since filed a bail application at the High Court.
In his application he stated that he was desirous of being admitted to bail and he intends to plead not guilty to the charges of attempted murder as at no point did he commit the said offences.

“On July 22, 2013 at the Manzini Nazarene traffic lights, I was involved in an  accident while driving a Toyota Quantum belonging to my employer  and when I approached the traffic lights, and while the traffic lights showed the orange sign, I passed only to collide with two kombis which were coming from opposite directions,” he stated.


He submitted that some of the passengers who were on board the kombis were injured and were rushed to Raleigh Fitkin Memorial Hospital where they were treated and discharged.
