‘BULL’ IN COURT FOR OUTSTANDING E50 000
MBABANE – It’s payback time for Mbabane Highlanders - literally. Moneni Pirates have instituted legal action against the capital city giants for an outstanding E50 000 owed in the sale of striker Mfanufikile ‘Fash’ Ndzimandze.
The application was filed last week Wednesday December 13, at the High Court and it is registered as case 1934 of 2017.
Pirates are represented by lawyers from Nzima and Associates.
The speedy forward was cleared for a fee of E150 000 to the ‘Black Bull’ by the ‘Buccaneers’ who were represented by Chairman Osborne Nzima.
Senator Ngomuyayona Gamedze, according to the papers filed by Pirates, signed on behalf of Highlanders in the agreement on August 26, 2017 in Manzini.
Highlanders’ incumbent Secretary, Mpumelelo Mnisi and Sabelo Tsabedze, signed as witnesses to the agreement.
Highlanders were expected to pay E80 000 deposit for the sale, before depositing E20 000 on August 29 to make the deposit E100 000.
The rest of the money was to be paid in instalments of four months, with the final payment due on 30 December.
However, the club alleged that Highlanders have failed, neglected and or refused to honour the latter part of the agreement. And they are demanding payment of the owed money at a nine per cent interest per annum.
They have given the black and white side 10 days to oppose the application, or the court to grant them their application.
The agreement gave Pirates the right to suspend the player in the case Highlanders were in breach.
The veracity of the allegations are still to be tested in a court of law and the respondent is yet to file their responding papers.
