EFA ORDERED TO APPOINT AD HOC APPEALS BOARD

MBABANE – Nsingizini Hotspurs were victorious yesterday at the High Court.

The High Court has ruled in favour of Nsingizini as it set aside the verdict by the Chairperson of the Eswatini Football Association (EFA) appeals board (first respondent) made on December 14, 2020 and on April 8, 2021.
The verdict is set aside as irregular, unlawful, irrational and grossly unreasonable on the grounds as set out in the applicant’s (Nsingizini) founding affidavit. The matter was before the Honourable Judge Justice M. Fakudze yesterday. Nsingizini, the applicant, through their legal representative, Zakhele Dlamini of Dlamini Kunene Attorneys, wanted the court to set aside the decision of the Appeals Board.

The High Court directed the Fourth Respondent (EFA) to constitute an ad hoc Appeals Board to determine the appeal filed by the applicant (Nsingizini Hotspurs Football Club) against the decision of the second respondent which is the EFA Appeals Board. “Having heard counsels for the applicant and for the first, second and fourth respondent and having perused the papers filed off record, by consent of the parties, it is hereby ordered that; the decisions of the first respondent made on the 14th December 2020 and on the 8th April 2021 are reviewed and set aside as irregular, unlawful, irrational and grossly unreasonable on the grounds as set out in the applicant’s founding affidavit.

‘‘The fourth respondent is directed to constitute an ad-hoc appeals board to determine the appeal filed by the applicant against the decision of the second respondent. Costs of the application are to be argued by the parties on a date to be fixed by the court,” read the court order.

For the record, Nsingizini are contesting the promotion of Amalanda to the first division league. This is after they (Nsingizini) were found guilty of using a defaulter in the playoffs match between the two teams played at King Sobhuza II Memorial Stadium last year. Nsingizini won the two-legged play-offs in the field of play. EFA is now expected to constitute an ad hoc Appeals Board to determine the appeal filed by Nsingizini.
