EX-‘BULL’ DIRECTOR SUES 4 SUPPORTERS
MBABANE - Former Mbabane Highlanders director Mduduzi Dlamini is suing four people for reporting him to the police that he had allegedly threatened Mbabane Highlanders boss Chief Ally Kgomongwe.
The former Director at the club alleged that the statements that were purportedly made by the four were understood to mean that he had threatened to kill Kgomongwe. Dlamini wants the court to direct Mcinisile Roy Mdluli, Simanga Phineas Maziya, Phephile Penelope Kunene and Solomon Methula to compensate him with a sum of E500 000 for alleged defamation.
Particulars
In his particulars of claim, Dlamini stated that on April 19, 2021, at Mbabane, the defendants (Mdluli, Maziya, Kunene and Methula), together with other people who were unknown to him, reported to the Mbabane Police Station that he had threatened Kgomongwe. According to Dlamini, the defendants allegedly went on to insult him and shouted expletives against him. He told the court that the defendants among other things allegedly said he was a bad influence in the club and to the players of Mbabane Highlanders. These are allegations contained in particulars of claim whose veracity is still to be tested and the defendants are yet to file their papers. He further highlighted that the defendants’ statements and allegations against him were reported by two newspapers circulating in the Kingdom of Eswatini on April 20, 2021, being the Times of Eswatini and the Eswatini Observer.
“The utterances by the defendants are devoid of any truth and are defamatory to the plaintiff (Dlamini) in his personal and professional capacity as a businessman, in that it was understood by members of the public to mean the plaintiff threatened to kill Chief Ally Kgomongwe and thereby was not a law abiding citizen. This placed him in bad light with his business associates, including future business associates,” reads part of the summons issued by Dlamini’s attorneys. He averred that as a result of the alleged defamation by the defendants, he incurred and sustained injury to his good name and reputation, to the extent of E500 000.
Submitted
The businessman submitted that the aforementioned amount was now due, owing and payable but despite lawful demand, the defendants refused, neglected and/or failed to pay same. In the summons, the defendants were informed that if they disputed the claim and wished to defend the action, they should within 10 days of service upon them of the summons, file with the registrar of the High Court, notice of intention to defend and serve a copy thereof to the plaintiff’s attorneys.
