EXCO ELECTIONS UNCONSTITUTIONAL - MASHUMI

EZULWINI – Should it occur that the Eswatini Football Association (EFA) elections are conducted by its executive, it would be unconstitutional!

This was the observation of Premier League of Eswatini (PLE) Executive Member Mashumi Shongwe yesterday during the EFA extra-ordinary meeting at the Happy Valley Hotel. The Rangers Chairman made this observation following submissions by some EFA delegates that the EFA Electoral Code had many shortcomings and must be put aside for now so that elections continued on June 27 as per the usual method. Hhhohho Regional Football Association (HRFA) delegate Nkosing’phile Shongwe had asserted that the document had conflicting provisions.

“It’s a good document but it must be taken back for amendments with the assistance of the Legal Committee,” he said. The delegate added that the elections must proceed and the new EFA executive be given the mandate to go and fix the document. Eswatini Referees’ Association (ERA) Chairman Sipho Kunene said he was in support of the Hhohho delegate especially on roping in the Legal Committee to assist fix the document. He said if this was not done, chances were high that legal implications ensued soon after the elections with losing candidates challenging the election process. “There is something good we should not ignore concerning the code. It gives powers to an independent committee to conduct elections which is something that is happening for the first time in Eswatini yet advocated for worldwide,” he said.

Shongwe said he supported that FIFA was to be consulted in fixing the document where it needed to be fixed and FIFA documents attached as proof. “However, if the upcoming EFA elections are conducted by the executive, it would be unconstitutional,” he said. Acting President Dr Comfort Shongwe noted that there were a lot of documents that needed to be amended as FIFA noted shortcomings. “This is a developing document, it will be continuously amended as time goes by to then reach near perfection,” said the acting president. He said the EFA Electoral Code was similar to the EFA statutes and the major difference was that the executive committee had been stripped of its vetting powers. He asked that delegates trusted the executive committee and said what they reported was communicated by FIFA was what FIFA had indeed communicated. Shongwe assured the meeting that the document will be sent back to the world football mother body for amendment where necessary.
