D-DAY FOR WANDERERS BY MACHAWE FAKUDZE

MBABANE – Judgment day!

This this is the marathon relegation battle between Manzini Wanderers and Denver Sundowns, which is now before Judge Mumcy Dlamini. This is after Judge Bonginkhosi Magagula recused himself from the matter. The matter began about five months ago, when Wanderers lodged a protest over Sundowns defender Jimoh Moses. This was during MTN Premier League relegation six-pointer, which was played at the Somhlolo National Stadium, where Ikappa Kappa won  4-2. Wanderers alleged that Moses had no valid work permit during that game.

The teams were hauled before the Eswatini Football Association (EFA) Disciplinary Committee (DC), which ruled in favour of Sundowns. The ruling by the Thulani Sibandze-chaired committee did not sit well with Wanderers and they took it to the EFA’s Appeals Board, which also dismissed the case. The matter was back in court yesterday before a new Judge (Dlamini), who adjourned the matter in the morning, after Moneni Pirates requested to be a party in the case. They were initially not part of the proceedings.

Interest

It was Moses’ representative Advocate Maziya, who also represented the ‘Sea Robbers’ of Moneni’, yesterday, who informed Dlamini that they had an interest in the outcome of the matter. Moneni can be relegated if Wanderers are granted three points. The judge granted Moneni the wish and the matter resumed at 3pm, yesterday. Upon resumption of the matter Advocate Maziya highlighted that he consulted with Lawyer Banele Ngcamphalala, who is the rightful representative of Denver Sundowns. Maziya brought it before Judge Dlamini that Ngcamphalala could not be present, as he was attending to a family issue.

“Ngcamphalala requested that the matter be postponed to Monday,” Maziya said. This request did not go well with Judge Dlamini, who said the matter should be put to rest considering that the extension of the registration closes today at midnight. “This matter cannot go beyond tomorrow (today),” Judge Dlamini said. The matter was adjourned for 10 minutes again, as Maziya wanted to consult on when they were to file their answering affidavit. He said they will file the answering affidavit by 8am, for Wanderers representatives SM Jele Attorney to reply on it. The judge then postponed the matter for today for its finality at 10am.
