WANDERERS LOSE COLANI CASE

MBABANE – The FA Players’ Status Committee has declared former Manzini Wanderers goalkeeper Colani Mngometulu a free agent.


The decision was communicated at Sigwaca House by the committee’s Chairman, Magistrate Siphosini Dlamini following a protracted battle between the team and the player.
The committee ordered that Wanderers should release all the player’s registration documents by noon on Monday so that he can join a team of his choice.


The player had requested the FA to intervene after the club had refused to release him despite that his contract, which he signed in October 2012, had expired on January 13, 2014.
However, Wanderers had claimed that the player signed a new contract on July 26, 2013 which was to expire on May 31, 2014.
The club, though failed to submit the new contract during the case, claimed that it disappeared at the FA registration office when they hastily registered the player for the 2013 Swazi Telecom Charity Cup match scheduled for July 27, 2013.


This was, however, contested by the player who in the case was represented by his Manager Zakhele Dlamini of TZD Sports Management.
In issuing the verdict, the magistrate said having gone through all the evidence and testimonies during the case, it was clear that the only contract that was submitted as evidence was the one that expired on January 13.

Wanderers failed to submit the new contract, but instead wanted the licence application form, Form D to stand as a contract.

“In conclusion, the committee find that Exhibit ‘B’ (which in this case was the contract that expired in January 13, 2014) is the last contract Applicant signed with Respondent. If there are any outstanding employer/employee disputes between the Respondent and Applicant there was relevant forums to address same,” reads the judgment.


He said the committee further found that the player’s contract with the club expired on January 13, 2014.
“This could be information but definitely not strange as the contract is unequivocal. Respondent is hereby ordered to release all relevant

documentation that will enable the Applicant to register with a team of his choice by noon on Monday 17 March 2014, failing which the NFAS should impose a football sanctions on Respondent,” the chairman said.
The committee advised any aggrieved party of its right to appeal with FIFA in accordance with Article 8.4 of the NFAS Statutes.
