Mpheni's company loses 11 vehicles
MBABANE – The MPD Group of Companies directed by Mpheni Dlomo has lost 11 of its vehicles and two canopies.
The property has been attached for a debt the former senator’s company has with Roots Construction.
The vehicles that go under the hammer this week are three trucks, seven motor vehicles, a tractor, a skid front loader and two canopies.
The property belonging to Dlomo’s company will be auctioned to recover a debt of E461 895.
Roots Construction has obtained a default judgment in its favour, declaring that MPD should pay the above amount.
According to the combined summons filed by Roots Construction in court, it concluded a construction agreement with MPD Group of Companies, which was in a joint venture partnership with a certain FED Investments (Pty) ltd, conducting business as a developer of the Big Tree Shopping Complex in Matsapha.
“A construction agreement was concluded between the plaintiff, as building contractor and the defendant as an employer,” states Roots Construction in the combined summons.
The company says it provided quotations where it was represented by Rueben Msibi while the MPD Group of Companies was represented by Dlomo.
Roots Construction was to construct the Big Tree Shopping Complex in Matsapha and its car park, in accordance with MPD’s plans.
MPD would, in turn, pay to Roots an amount in respect of the construction work equal to the sum of E3 689 902.
Also, an amount of E572 438 was to be paid to one of the supervising officers appointed by the defendant, this being Andreas Mkhatshwa.
Rose Maphanga was to state the exact amount required to complete the construction work.
The contractor stated that it duly executed and completed the construction work and FED effected certain payments to Roots Construction on behalf of MPD.
Mkhatshwa issued three certificates on behalf of MPD, in aggregate sums of E643 839 namely an amount of E135 000 on September 6, 2006 and E144 951 on September 18, 2007.
A further sum of E363 888, which remain unpaid by the defendant was also certified.
These amounts remained unpaid, notwithstanding the lapsing of a period of 14 days from the date of issue of the certificates.
MPD neither defended nor opposed the application thus the High Court granted a default judgment. “Be pleased to take notice that the auction commences at 10 am at the MPD Group of Companies head office, (opposite Unitrans) December 9, (Wednesday) 2009.
Thereafter, to the premises of Autoland (old Ngwane Mills premises) where the remainder of the vehicles will be sold,” reads part of the writ of execution.
The auction will be conducted by Deputy Sheriff Martin Arker.
