Don't refer to judges as either junior or senior, lawyer told

MBABANE - High Court Judge, Bheki Maphalala shared a light moment with lawyer Mduduzi Mabila yesterday at the High Court.

The judge told Mabila not to refer to judges as either junior or senior. This was after Mabila had told the judge that he has a matter that is pending before Judge Maphalala ‘senior’ which automatically meant that there was another judge who is Maphalala’s junior.

"No, no, no, never refer to judges as either junior or senior. Rather use ‘principal’ instead," said Maphalala with a broad smile on his face, something unusual for him when he is in court.

The judge said this during the matter between the state and Bongwa Mcondisi Dlamini who is charged with attempted murder.

This is an offence which he allegedly committed at Magevini where he attempted to kill one Khumbuzile Khumalo*, his girlfriend. He was expected to resume his defence in the matter after the crown had concluded its case. Mabila, said he had not had time to take instructions from his client before the case could resume and requested the postponement of the case.

The matter was then postponed to August 18, when the defence has to lead evidence before mitigation.
